Website Maintenance Terms of Service

Before purchasing a website maintenance agreement from Grow Development, you must read and agree to this Terms of Service ("TOS").  By using Grow Development services (the "Service"), you agree to be bound by the TOS and you agree that it is enforceable as if it were a written negotiated agreement signed by Grow Development ("COMPANY") and you.


Grow Development may, in its sole discretion, modify or revise the TOS at any time without notice to you, and you agree to be bound by modifications or revisions.  Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to the TOS. Continued use of the Service after any such changes shall constitute your consent to such changes. Pricing. 
The pricing table is listed on the website maintenance page. If any work goes beyond the slated number of hours your plan allows we will inform you before continuing with any changes/updates.

Subscription Period.  Maintenance packages can be purchased for 3, 6 or 12 months.  This is paid up front. Any price increases will not apply to your account for the remainder of your subscription period.


Payment Terms. Monthly Terms:  A valid credit card is required for you to continue using the Service.  The service is billed in advance on a monthly basis and is non-refundable.  After the subscription period ends you will be automatically renewed unless you wish to discontinue the service or switch over to a different plan.  There will be no refunds or credits for partial months of service, upgrade/downgrade accounts, or for months unused with an open account.  Accounts will auto-renew for the duration they were originally purchased for unless cancelled by you.


Cancellation and Termination. 
You are solely responsible for the proper cancellation of your account.  You may cancel your account at any time by emailing the COMPANY to state cancellation of service 3 business days before the renewal date.  There will be no refund if you cancel the Service before the end of your current, paid-up duration, and you will not be charged thereafter.  There is no cancellation fee.  Cancellation is immediate, and all of your Content will be immediately deleted from the Service upon cancellation. 


Timeline for Changes.  We strive to make any changes within a 48 hour period (excluding weekends and holidays). While we do not guarantee this timeframe we will notify you immediately if your changes will take more than the 48 hour period.  For larger or more complicated changes, timeline will be addressed on an individual basis.
 

Confidentiality.  In order to function as a maintenance service, Grow Development will require certain confidential information such as (but not limited to) login information, ftp and email information, etc. We will take reasonable steps to insure this information is kept in the strictest confidence. No information shall be given to any third party without agreement and confirmation from client.
